1. Overview

The website toppyhome.shop (the "Site") is operated by NEGRON, doing business as ToppyHome ("we," "us," "our"). By visiting the Site or buying from us, you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the Site.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order.

3. Products and descriptions

All products we sell are new. We try to describe and photograph products accurately, but colors may vary by screen and manufacturers may update specifications. ToppyHome is an independent retailer and is not an authorized dealer for the brands we sell. Brand names and trademarks belong to their respective owners, and their use does not imply endorsement.

4. Prices and availability

Prices are in US dollars and may change without notice. We reserve the right to correct pricing or description errors and to cancel orders affected by such errors, with a full refund. We may limit quantities or refuse orders, for example if we suspect fraud.

5. Orders and payment

Your order is an offer to buy. We accept it when we ship it. Payment is processed securely at checkout. Applicable sales tax is calculated at checkout.

6. Shipping, returns and warranty

Shipping, returns and warranty are governed by our Shipping Policy, Refund Policy and 2-Year Limited Warranty, which are part of these Terms.

7. Safe use and installation

Grills and smokers involve fire, high heat, fuel and, for gas and electric models, gas lines and electricity. Always follow the manufacturer's instructions and local codes. Use outdoor products outdoors only. Built-in grills must be installed in non-combustible enclosures, and gas connections should be made by a licensed professional.

8. Use of the Site

You agree not to misuse the Site, interfere with its operation, attempt unauthorized access, or use it for unlawful purposes. Content on the Site, including text, design and our own images, belongs to us or our licensors and may not be copied without permission.

9. Disclaimers

Except for the express warranties in our 2-Year Limited Warranty and as required by law, the Site and its content are provided "as is." Our warranty obligations for products are set out in our Warranty.

10. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential damages arising from your use of the Site or products. Our total liability for any claim relating to a product will not exceed the amount you paid for that product. Some states do not allow these limits, so they may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.

11. Governing law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in New York County, New York, unless applicable law gives you the right to bring a claim where you live.
